Introduction

Welcome to Billing Care Solutions. These Terms and Conditions govern your use of our medical billing services. By accessing or using our services, you agree to comply with and be bound by these terms. If you do not agree with these Terms and Conditions, please do not use our services.

Definitions

Company: refers to Billing Care Solutions.
Client: refers to any healthcare provider, hospital, clinic, or other entity that uses our services.
Services: refers to medical billing, claim submission, payment collections, and related activities provided by the Company.

Services Provided

• Submission of claims to insurance providers.
• Follow-up on unpaid claims.
• Payment posting and reporting.
• Denial management and appeals.

We commit to submitting accurate and timely billing information but rely on the accuracy of data provided by the Client.

Client Responsibilities

• Accurate Information: The Client must provide correct and timely patient and insurance data.
• Compliance: The Client must comply with HIPAA and other applicable laws.
• Cooperation: The Client agrees to cooperate with audits and provide requested information.

Payment Terms

• Pricing: Fees are based on a percentage of collections or flat fee, as agreed in writing.
• Billing Cycle: Invoices are issued monthly and due within 30 days.
• Late Payments: Payments not made within 30 days incur a 1.5% monthly late fee.

Data Privacy and Security

Billing Care Solutions complies with HIPAA and takes all necessary measures to ensure data confidentiality through encryption, secure storage, and controlled access.

We will not share any personal or medical information without consent, except as required by law or necessary to perform our services.

Limitation of Liability

• Errors and Omissions: We are not responsible for errors caused by inaccurate data from the Client.
• Damages: Our total liability is limited to the amount paid by the Client for services in the past 3 months.

Termination

• By Client: Services may be terminated with 30 days’ written notice.
• By Company: The Company may terminate with 30 days’ notice or immediately in cases of breach or illegal activity.

Upon termination, all outstanding invoices must be paid within 30 days.

Dispute Resolution

Governing Law: These terms are governed by the laws of the state in which Billing Care Solutions is registered.

Resolution: Disputes shall be resolved through mediation, and if unresolved, in a competent court of jurisdiction.

Amendments

Billing Care Solutions reserves the right to modify these Terms and Conditions at any time. Clients will be notified 30 days before any material changes take effect.

Force Majeure

We are not liable for failures due to causes beyond our control, including natural disasters, war, or government restrictions.

Entire Agreement

These Terms and Conditions, along with any signed agreements, represent the entire agreement between Billing Care Solutions and the Client and supersede all previous understandings.
